Employ landlord’s ward: court

MADURAI: The Madurai Bench of the Madras High Court on Thursday directed the Nuclear Power Corporation of India Limited (NPCIL) to employ the daughter of a landlord who had parted with his property for the Atomic Power Project at Koodankulam in Tirunelveli district.
Allowing a writ petition filed by the girl, Justice P.D. Dinakaran said that it was “arbitrary and unreasonable” to deny her employment ignoring the assurance given while acquiring the land. Hence, he ordered appointment of the petitioner in any suitable post equivalent to Junior Assistant (Grade II) within four weeks.
The Judge was not satisfied with the stand taken by NPCIL that the petitioner could not be employed because she stood at 10th position in a test written by 41 candidates for occupying seven vacancies.
“There is no explanation in the counter affidavit as to why the petitioner was not given preference as per the employment preference certificate issued to her while acquiring the land,” he said.
In her affidavit, the petitioner, Hairlin Jeya Sutha, said that she was a Computer Science graduate. The State Government, in 1993, acquired the lands owned by her father for the Atomic Power Project. Then, an employment preference certificate was issued to her certifying that her family’s livelihood was affected owing to the acquisition and hence she would be considered for employment in NPCIL.
The petitioner’s counsel, T.S.R. Venkataramana, contended that it was not fair on the part of NPCIL to not fulfil a commitment made by it to the petitioner. He claimed that the petitioner was not given any preference but only permitted to contest for the vacancies along with other candidates.
