Delhi HC dismisses complaints against M.F. Husain

NEW DELHI,
APRIL 8.
The Delhi High Court today dismissed eight criminal complaints against artist, M.F. Husain, for allegedly "promoting enmity between different groups ... by painting Hindu goddesses Durga and Sarswati in an uncharitable manner hurting the sentiments of Hindus".
Justice J.D. Kapoor, dismissed the complaints which had been filed at different places in the country and later collectively transferred to a Delhi court for trial, saying the prosecution failed to take the sanction of the Union Government or of the State Governments concerned for prosecuting the artist as is required for sending a person up for trial under Section of IPC.
Mr. Husain had approached the High Court for quashing of the trial court proceedings.
Though the paintings in question had been painted by Mr. Husain in 1970, it became an issue of public debate when "Vichar Mimansa", a Hindi monthly magazine (since wound up) published them along with an article headlined "M.F. Husain: A Painter or Butcher" in one of its issues in 1996.
