'Cannot be withdrawn'

NEW DELHI APRIL 6. The Delhi High Court judge, Shameet Mukherjee, cannot withdraw his resignation, which was tendered in the wake of the controversy linking his name to the DDA scam, and it should be accepted, the Law Ministry has said in its opinion to the President.

The Ministry is believed to have taken the view that a resignation comes into immediate effect the moment it reaches the Government. Mr. Justice Mukherjee's resignation became effective the moment it was submitted to the President, a top Ministry official said.
