Banning pan masala: HC asks Govt. to issue fresh order

KOCHI, MAY 31. A Division Bench of the Kerala High Court on
Thursday directed the State Government to issue a fresh
notification banning the manufacture, storage and sale of pan
masala in the State.
The interim direction was issued by a Bench comprising the Chief
Justice, Ms. K.K. Usha, and Mr. Justice Kurian Joseph as the
State Government submitted that there were some flaws in the 1998
order banning the manufacture, storage and sale of pan masala.
When a pending writ petition filed by Mr. P.K. Abdul Khader and
others of Thrissur came up today, the State Government submitted
that it was prepared to withdraw the flawed order and introduce a
fresh one. The notification was issued under Section 7(IV) of the
Prevention of Food Adulteration Act, 1954.
According to the Section, the State Government can ban
adulterated food for a temporary period.
