Governor will reject Jayalalitha claim: Swamy

MADURAI, MAY 8. The May 10 election will throw a `hung Assembly' in the State, according to Dr. Subramanian Swamy, Janata Party president.

Addressing presspersons here today, Dr. Swamy said even if the AIADMK legislature party chose Ms. Jayalalitha leader, the Governor would have to reject her candidature. ``Having rejected her candidature, the Governor, by convention, will call the next largest party to form the Government.'' This would be ``the danger'' in electing Ms. Jayalalitha the leader of the legislature party or the AIADMK-led group, in the face of her ``clear disqualification.''

Asked how the Governor could reject the nomination in case of the AIADMK gaining a majority, Dr. Swamy said in a democracy ``the rule of majority should be within the framework of law.'' The Governor, in order to uphold the Constitution and law, had the right ``not only to reject Ms. Jayalalitha's nomination but also invite the second largest party to form the Government.'' This was the constitutional position and similar situations had occurred in Germany and Japan. He did not rule out the possibility of horse trading in the event of the second largest group being asked to form the Government.

Dr. Swamy said his party workers were instructed to work for the defeat of the candidates of the AIADMK-led front, except in the 25 constituencies where the party contested in alliance with the Bharatiya Forward Bloc. Ms. V. S. Chandralekha, State president, said the elected members of her party would support the DMK front in the formation of the Government.
