SC issues notice to J&K Home Secretary

NEW DELHI, MAY 2. The Supreme Court today issued notice to the
Jammu and Kashmir Home Secretary to show cause why action must
not be taken against him for not complying with the Court's
earlier order directing the State to file affidavit indicating
the steps taken in the matter of creation of new courts, filling
up of vacancies of judges and provision of infrastructure for
those courts.
The Home Secretary was directed to be present in the court on
July 26.
The Chief Justice, Mr. A.S. Anand, Mr. Justice R.C. Lahoti and
Mr. Justice Doraiswamy Raju were on the Bench.
The Bench, at an earlier hearing of the matter, a public interest
litigation on the plight of undertrial prisoners in various
States, had cautioned that if the information sought by the court
was not furnished by the State Governments and Union Territories,
the defaulting States should each file their responses with a
cost of Rs.5000 and the concerned Home Secretaries shall also be
personally present in the court.
It appears that the Jammu and Kashmir Government had neither
deposited the cost of Rs.5000 nor filed the affidavit.
